Ridiculous. I say release it and take your chances. Chuck Berry probably isn't coherant enough at this point to know the difference.![]()
From ElvisNews.com:
Official Message Warner USA
As soon that the fan world learned that ‘Johnny B Goode’ was replaced by ‘Don’t Be Cruel’ on the opening credits of ‘Elvis On Tour’, hundreds of reactions where written on various message boards. Lots of fans are blaming Warner or EPE (who don’t even own the On Tour footage) for not doing a good job on this release.
Tom Lucas, VP Marketing manager of Warner USA, explains: The moment Warner decided to release a restored version for ‘Elvis On Tour’, they contacted all the composers and publishers for the songs that are included in the movie. In case of ‘Johnny B Goode’, they never received any reaction from composer Chuck Berry or his publisher.
Warner tried to contact them for a very long time, but never received any reply or contract. It is not the case that Warner did not want to pay enough money to include the song, they simply did not receive an offer to pay for it.
Warner had two options left: forget the whole project and put it back in the vault, or release it with another intro. The fact that they choose ‘Don’t Be Cruel’ and the editing that was used on it, is food for another discussion. Although the opening (only 87sec!) is altered, we still are very happy that we can enjoy the rest of the movie in great quality!
Something seems fishy to me on this...but nevertheless, there is the "official" word!!!

I would have to differ with you about Chuck Berry-a couple nights ago he played in his hometown of St Louis at a concert to try and convince the Democratic Party to have their 2012 convention in St Louis. They showed clips of it on the local newscast and for a person around 80 he looked and played amazingly well.
He is very very hardnosed when it comes to business-he was outfoxed in the 1950s a time or two and it convinced him the only way to do business was to be ruthless.
But in this situation I really do not know why he or the publisher would not want to make money-which I'm sure they would have if they had made a deal.
Work in Progress!
I wouldn't give Chuck Berry a hard time because he didn't respond and give EPE the option. I'm grateful that they found an alternate song to put in the opening credits so that they can finally release this on DVD. I don't feel it ruins the movie.
Ok, whatever; but wasn't Burning Love or Big Hunk O' Love, from the same rehearsals Johnny B was taken, much better choices as they match the energy of the original opening, instead of the lighthearted version of Don't Be Cruel?
Something about this whole situation seems fishy to me...
I can't believe that Chuck or his management never responded to Warner's requests for usage of JBG in the film. As you pointed out Ken, using JBG in the film would certainly make Chuck a tidy little sum of money...and to just outright ignore something like that??? It just doesn't make any sense.
It will be interesting to see if there is some kind of a response by Chuck or his management concerning Warner's statement...

Perhaps I am mistaken-but in the 90s when Warners released the VHS version of Aloha, didn't they also claim it was because they got no response from the letters they sent concerning JBG, and a couple other songs??? I seem to recall something similar to this before.![]()
Work in Progress!
Burning Love would have been a great alternate choice I think, very high energy.

One of the many issues I have with the legality behind these things.

Wasn't Lightyear Entertanment not Warner the people behing the 90's vhs of Aloha? Or are they related?
Anyhow, despite how fishy all of this sounds, none of that is a good reason to explain the poor choice and lousy sound edition on the new opening.
My good this is the XXI century, with a free download trial program (yes that cheap!) I could have made something better. Christ it is not that hard, just a bit of imagination and a day off, did they actually paid someone for that piece of crap? Give DJ Ethan the job!!!!
The reason for such a poor choice and edit job is then again obvious to me, despite Jorgensen and his team, people running Elvis projects does not have a clue of what Elvis is about, and so ,what does the real fans WANT and does NOT want to see!!!
Sorry to be so cranky but YES, that new opening does IRRITATES ME THE MOST!!! Legal issues are one thing, PLAIN MEDIOCRITY is another.

I know many people will say, well skip it and enjoy the rest of the movie in superb sound and HD quality etc. Well yes, but how you like next FTD Cd or the Viva Elvis CD coming soon, all sounding superb but with the first track (for no reason) sounding like crap.
How you like your remaster on blueray of "Easy Rider" but with a diffrent song on the opening credits scene, how you like "Star Wars" without the John Williams classic opening theme? Is not just about Elvis, its about the integrity of the movie as a whole!!!
Wait, how you like FTD finally releasing Promised Land without Promised Land on it! lol
ARGHHH!!! Needed to take all that out.
I am glad I have my copy on VHS, they should have replaced it with something better than a Don't Be Cruel, Burning Love, Promised Land, something else.
I so that and I do plan on getting the dvd and eventually Blu Ray, it just sucks they ruined such a killer opener with JBG.
After all, it was expected. As those 2 enterprises didn't get an agreement, fans already new something like this was gonna happen. ¬¬
You know what... I would like to see the movie in theather anyway!!!!! At least in USA you had that chance...No matter if it's Don't be Cruel or JBG. Just Elvis in big screen..... Ppl in USA u r so lucky fot that, don't waste it.
Let the stars fade and fall, and I won't care at all, as long as I have you.

Lightyear was affiliated with Warners for a number of years in the 90s-it released Aloha-in looking up that release I found this info on it on E-Bay:
Movie description
Elvis Presley performs in Honolulu, Hawaii, in this 1973 concert. Among the 25 titles included are "Blue Suede Shoes," "Suspicious Minds," and "C.C. Rider." Elvis made television and entertainment history as this was the first-ever live concert broadcast over satellite, reaching in excess of one billion people worldwide. Note: Elvis' performances of I'm So Lonesome I Could Cry, I Can't Stop Loving You, and Johnny B. Goode in the Aloha From Hawaii concert have been deleted from the newly re-released DVD/VHS editions of this program. Music publishing clearance from the songs' owners was up for renewal and an agreement could not be reached. This edited version is the only available version of Elvis' historic Aloha From Hawaii concert.
Work in Progress!
Again a major screw up, like we expected.
Come to think of it, didn't we all buy that Hawaii show with the missing tracks? Yes, most of us did. And then later it got a release with the songs in it. Double trouble for us, double winnings for those companies.
I bet things will go the same with Elvis On Tour. In no time there will be a special release with JBG in it, and some extras as well.
Do we buy Elvis On Tour, even without JBG? Right now I say, no I will not. Like some of you I think.
In the end we will buy it anyway....
And the updated release when it comes on the market in say 2 years from now.
Good going Warner Bros!
