Dear Mr. Kenny:

This letter is sent to demand that you immediately withdraw the "elvis audio" and ''elvis photos'' presently featured on the "kenny elvis" you administer on the Internet.

This office represents Elvis Presley Enterprises, Inc. ("EPE"). "EPE is the assignee of state and federal trademarks, service marks, copyrights, and indentification [publicity] rights of the estate of Elvis Presley..." Elvis Presley Enterprises, Inc. vs. Elvisly Yours, Inc., 936 F.2d 889, 892 (6th Cir. 1991).

It has just come to EPE's attention that you administer an "Elvis Home Page" on the Internet at http://www.kennyelvis.net/ and that said home page includes bootlegs material,audio,copyrighted pictures copyrighted by EPE.

with the above-described images and songs infringes EPE's rights in numerous ways, including but not limited to the following:

(1) It infringed EPE's exclusive right to copy, distribute, and create derivatives of its copyrighted images of Elvis in violation of 17 U.S.C. Section 101 et seq.;

(2) It infringes EPE's copyrights in the music used in violation of 17 U.S.C. Section 101 et seq;

(3) It infringes EPE's publicity rights in the name, voice, and likeness of Elvis Presley under state law.

If you have recieved copyrights of the photographers then you MUST send a copy of each of your photos so the epe picture section can verify the photographers have been informed of the use of their pictures.

On behalf of EPE we demand that you immediately withdraw the "mentioned material" from your site on the Internet, and that you agree in writing: 1) that you will not in the future reproduce or make publicly available or any portion thereof by computer database or otherwise, and 2) that you will engage in no further actions
that infringe EPE's rights. Please be advised that if the mentioned material is not removed from the Internet, and if we do not receive the above- described written confirmation, within 7 days of the date of this letter, EPE will have no choice but to exercise its rights under the law to their fullest extent.

Well, you know Kenny, it's because they have not profited enough of their milk cow Elvis yet. Oh yes, they love him dearly, but only because he can rake in millions of dollars for them. It's the dollar signs talking, the subject I started a thread about in The selling of Elvis (http://www.tcb-world.com/showthread.php?t=1630).

They want to squeeze anybody out of business, especially those who give stuff to the fandom for free. They're operating in a very UN-ELVISLY way :angry: :cursing: :nono:
Where Elvis was all about generosity, they're mostly about greed. Elvis is just a product, a trademark to them. The man has ceased to exist as a human being for the company that bears his initials :nono: :'(

Ohhhhhhhhhh, man. Jordan's Elvis World is getting crap from them (again) here lately too. That just sucks...and we all suffer for it--just as EPE themselves do, but they apparently aren't going to come to that realization any time soon. Like Ron said, that is indeed puzzling about the photographs. The whole thing is very irksome and disheartening, but not altogether surprising. Very sorry to hear it, Kenny.

Wow! Sorry to hear that EPE is being real jackass' about your site. From what I read Jordon is getting heat from them as well. It makes no sense to me. What do they think they are going to accomplish other than alienating true die hard Elvis fans from EPE, by the acts of total jealousy and stupidity. I'm very sorry to hear that Kenny and like mentioned before I cannot understand why, especially the pictures. I hope they come to their senses and realize that sites like yours and Jordan keep the memorie of Elvis alive. Are they going to provide the same service as you do, or are they only going to stick to their 'memorablia'. What is the purpose of shutting sites down if your not going to do anything with that kind of material.

It's a shame that EPE only contacts websites when they want to shut them down. How many people who invest hours and hours of their freetime to maintain a website to honour Elvis have received a friendly email from EPE? Just a note that they appreciate it or something?

The differences between you and them is that they get paid for their work, and you pay (for webspace, etc.) for your Elvis work. A shame that the passion (and love and appreciation for the fans) is gone. I'm very curious how many people working for EPE are in fact Elvisfans? I think that for most of them it's just a job.

And what a stupid story about the pictures? It's not like you're making money of it, or using them in millionselling papers. It's just for fun and for fellow Elvisfans. And most of them are from 1973-1977, the era that doesn't exist in EPE's books for crying out loud!

I fully support their "war on copied Elvismusic", or their hunt for all those 'best of' CD's illegally printed in East Asia (and polluting Ebay). But to pick on tribute sites like the one from Kenny is stupid and even childish. They obviously aren't aware of the importance of websites like the one from Kenny. The Elvisfans aren't on sites like www.bmg.com, but on sites like www.kennyelvis.com, FECC, Jordansworld or elvisnews.com.

Sad to hear they are coming after you Kenny. Wish those guys had the common sense to differentiate who or which sites make money off Elvis and those like yours or even this one- which is just a hobby or a life's passion.

It is this attitude that at times makes me feel that I should skip visiting Graceland and keep it as the dream I have had for most of my life. I just dont feel like spending money to keep a greedy and mostly mindless corporation - their selling Boxer shorts prove that for me - I have already stopped visiting elvis.com and this seems to be the next logical step. Ignore them.

I totally agree with you jbgude,

I have a very mixed feeling about EPE. On the one hand I still have that childish feeling that EPE is closely related to Elvis' family, filled with people who have a connection with and love for our man. But on the other hand I realise that it's just a business like any other where the main goal is to make more profit.

I don't know if you people know the "Bear Family" label? That's a German label started by musiclovers. Their main goal is to buy the musicrights from old (mostly) country artists and release the music in big boxsets. They want to honour those artists by releasing their music in a wonderfull way: big boxsets with large booklets filled with beautiful pictures. And the price is low. They say "those artists have given the world so much joy with their music, the least that we can do is to keep it available to the world in the best way". They are not aiming in making profit: once a boxset has been released, they will keep on selling it. More profitable artists will make up for less-selling artists.

That's the way recordcompanies should see their old catelogue stars. It's also an example for The Elvis Estate. They can learn much from it.

The mail from epe was a big joke, i contcted a few of my real good friends, and we found out that it have to be a joke.
Last year i got a real mail from epe, first i got a very importen email, a few days later i got a letter in my mailbox.
I dont think this will come this time, but they finish it up real good thouse shi :angry: people, my pc have a virus i cant get hold on, it look like it only go one way.

It's just a fake ...I guess there's someone who owns the right of ONE of the pic's or other material And want to get you scared...Well Elvis is not just ONEs property..Elvis was gifted and wanted to share that gift And you want to share the gifts he gave us...As we all do overhere..I send my homemade clips and MP3s and pics not to earn money with it, but just to share the good feeling it gives when one sees a new clip or a new pic..Or hear a new mix or what else....That's it..Give the guy a break ...and clean up your own backyard first......
